1. General Provisions

The operator and administrator of the online store available at www.tripplanner.pro is TALENT DEVELOPMENT INSTITUTE SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered at Kutnowska 1-3/31, 53-135 Wrocław, Poland, under KRS: 0001147761, NIP: 8993013258, REGON: 54060410000000, hereinafter referred to as the "Seller". The Seller is the party to the sales contracts concluded through the online store and the data controller of the personal data provided by Buyers via www.tripplanner.pro.
These Terms & Conditions define the conditions for making purchases in the online store.
The provisions of these Terms & Conditions do not intend to limit or exclude the rights of consumers or natural persons who conclude a contract directly related to their business activity, provided that it does not have a professional character based on their registered business scope. Any doubts regarding the provisions of these Terms & Conditions shall be interpreted in favor of the above-mentioned categories of persons. If any provision of the Terms & Conditions is found to be inconsistent with applicable mandatory legal provisions, such provision shall be considered invalid by law.
The administrator of personal data processed in the online store in connection with the implementation of these Terms & Conditions is the Seller. Personal data is processed for purposes, for the duration, and based on the principles specified in the Privacy Policy, which is published on the store’s website. The Privacy Policy defines the rules for processing personal data by the administrator, including the basis, purposes, and duration of processing, as well as the rights of individuals whose data is processed.
Using the online store, including making purchases, is voluntary. Similarly, providing personal data by the user or customer of the store is voluntary, except in cases specified in the Privacy Policy (e.g., contract execution and legal obligations of the Seller).

2. Service Prices

The prices of services provided by the Seller include VAT and are expressed in Polish Zloty (PLN) and Euro (EUR).
The prices do not include additional fees for other possible accompanying services. The Buyer is informed about any additional service costs at the time of ordering and on the order summary screen.

3. Conclusion of the Sales Contract

Any commercial information displayed on the online store website, including prices and descriptions of services, does not constitute an offer but rather an invitation to make a purchase offer.
Placing an order by the Buyer is equivalent to submitting an offer to purchase.
The sales contract is concluded once the Seller receives the payment.
The confirmation of the order acceptance is sent via email to the Buyer’s address provided at the time of order placement.
Creating a customer account in the online store is not required to place an order. Personal data provided during registration is used solely for the execution of the contract, informational purposes (e.g., important updates and product modifications), marketing, and advertising. Buyers can withdraw their consent to receive such communications at any time.
If the Buyer does not complete the payment within 5 business days of placing the order, the purchase offer is considered withdrawn.

4. Right to Withdraw from the Contract

The Buyer may withdraw from the contract within 14 days from the date of conclusion without providing any reason. After this period, the right to withdraw expires.
To withdraw, the Buyer must send a withdrawal statement via email to info@tripplanner.pro.
In case of withdrawal, the Seller will refund all received payments within 14 days from receiving the withdrawal statement.
Refunds are made to the account from which the payment was made unless the Buyer requests a different method in the withdrawal statement.
By downloading digital files, the Buyer agrees to immediate fulfillment of the service and acknowledges that this results in the loss of the right to withdraw from the contract.
The above provisions do not apply to non-consumer Buyers or those entering contracts directly related to their business activities, where such contracts do not have a professional nature.

5. Payments

Buyers can pay via fast online transfers, credit card payments, and other electronic payment methods through PayU.pl.
Payment is considered completed when funds are credited to the Seller’s account or when confirmation of successful authorization is received from the online payment service.
The Seller reserves the right to allow alternative payment methods upon individual arrangements with the Buyer.

6. Delivery

Delivery time for products is up to 5 business days, unless a shorter delivery period is specified in the product description.
For digital products (e.g., eBooks), access is granted via email immediately after purchase.
The Buyer agrees to receive invoices in electronic form unless they request traditional paper invoices.

7. Terms of Use – Digital Content & Services

The rights to the Products, including copyrights, belong to the Seller or legally authorized third parties.
Buyers do not obtain ownership of any intellectual property rights to the purchased Products.
Products are for personal use only. The following actions are strictly prohibited:
Sharing the product with third parties.
Using it for commercial purposes (reselling, sublicensing, etc.).
Modifying, copying, translating, or distributing any part of the content.
The Seller may update the digital product to ensure compatibility with new technical environments, provided such updates do not result in additional costs for the Buyer.

8. Warranty, Complaints, and Liability

The Seller is responsible for product defects according to applicable legal regulations.
Complaints must be submitted via email to info@tripplanner.pro, including details of the defect and any relevant supporting materials (e.g., screenshots, photos).
Complaints are processed within 14 days of receipt.
The Seller’s liability for defects is excluded for non-consumer Buyers.

9. Processing of Personal Data

The Seller is the Data Controller, and data processing is carried out in compliance with GDPR (Regulation (EU) 2016/679).
Personal data is processed for:
Order processing and contract execution.
Legal obligations (e.g., accounting regulations).
Marketing purposes (if consent is given).
Detailed data processing rules are specified in the Privacy Policy.

10. Final Provisions

Placing an order in the online store requires accepting these Terms & Conditions.
Any disputes with non-consumer Buyers will be resolved by the court competent for the Seller’s registered office.
The Seller reserves the right to modify these Terms & Conditions, with changes taking effect upon publication.
Consumer Buyers can use the EU Online Dispute Resolution platform (ODR) at: http://ec.europa.eu/consumers/odr/.
These Terms & Conditions are effective as of March 25, 2023.
